Fullerton Beck’s Early Investigation Leads to Discontinuance in Premises Liability Case

Fullerton Beck partner Gerard Crowe secured a discontinuance in a premises liability lawsuit, marking his second discontinuance in recent months and more than a dozen over the past year. The result removed the firm’s client, a property management company, from litigation stemming from an alleged fall at a cooperative complex in Jefferson Valley, New York.
The claims were discontinued after Gerry demonstrated that the alleged accident occurred on property belonging to a different cooperative within the Jefferson Village community in Yorktown, Westchester County.

The plaintiff had initially named two cooperative entities and two management companies, reflecting confusion about the ownership structure of the multi-building development. Through client affidavits and supporting documentation, Fullerton Beck established that its client had no responsibility for the location where the incident occurred.

Once the correct party was identified, the plaintiff discontinued the claims against our client, allowing the company to exit the case before costly discovery began.
The matter was resolved with limited legal work, avoiding the significant expenses typically associated with depositions, motion practice and extended litigation.
