Fullerton Beck Wins Dismissal of All Claims in Federal Case Against ASPCA Humane Investigators in Ulster County
Fullerton Beck prevailed on a motion to dismiss in a federal case in the Northern District of New York. The litigation team, led by Partner Joseph Sauer, moved to dismiss a civil case brought by a former animal shelter operator who alleged false arrest, malicious prosecution, conspiracy, defamation, and constitutional violations against several defendants, including two investigators represented by the firm.
The plaintiff, a former investigator with the Ulster County ASPCA, alleged she was terminated from her position without cause, and later started her own animal shelter. Following multiple complaints about the sale of severely ill dogs, the matter was reported to authorities. Based on the evidence gathered, an arrest and search warrant were issued and executed by the humane investigators in coordination with law enforcement.
After conducting extensive investigation, Joe moved to dismiss the claims, arguing that the pleadings failed to establish the necessary elements for the alleged causes of action. The court agreed and found the arrest was privileged due to a valid judicially issued warrant. The court further dismissed the plaintiff’s remaining claims, citing lack of factual and legal basis.
