Fullerton Beck Secures Summary Judgment for Institutional Client Through Collaborative Motion Practice

Fullerton Beck LLP secured a significant litigation victory on behalf of an institutional client, obtaining summary judgment and full dismissal of claims arising from a high exposure personal injury matter.

The case involved allegations that work performed on a public roadway contributed to an unlevel manhole cover that caused serious injury. The client was brought into the matter during discovery based on the possibility that its prior work on the street may have created or contributed to the condition at issue.

Working in close partnership with the client’s in house legal team, Fullerton Beck attorneys drafted a comprehensive, fact intensive motion for summary judgment. The motion required a detailed evaluation of the client’s historical work records over an extended period, far exceeding the typical review window. Attorneys methodically analyzed and addressed numerous instances of prior work on the roadway, demonstrating that none occurred at the location of the alleged defect or could have caused the condition at issue.

Despite a substantive opposition, the court determined that the evidentiary record established that the client’s work was not responsible for the hazardous condition. The motion was granted in full, resulting in the client’s dismissal from a case involving substantial alleged damages.
