Victoria Ronemus obtains dismissal of a NY Labor Law complaint and cross-claims asserted against our client seeking contractual indemnification in a case involving an accident that allegedly occurred on temporary stair tower on a job site.

The plaintiff allegedly fell as a result of wet stairs and inadequate lighting installed by our client. Victoria successfully argued that the accident did not arise from our client’s lighting work and that the General Contractor prematurely opened the stair tower for the workers to use prior to our completion of the contracted work. In support of our argument, Victoria utilized the General Contractor’s own project records in support of the firm’s motion seeking dismissal of the plaintiff’s complaint.
